Article 1 - Identification and generalities
1.1 "Tram Experience" is an initiative implemented by the visit.brussels ASBL [non-profit organisation] (hereafter “visit.brussels”), with registered headquarters at Rue Royale 2-4, 1000 Brussels, in partnership with the Société des Transports Intercommunaux de Bruxelles (STIB) (hereafter “the Organizers”).
1.2 Reservation of a ticket for a “Tram Experience” evening (hereafter “the Ticket”) via the sites www.visit.brussels / www.tramexperience.brussels or at the sales offices located on the Grand-Place or at Rue Royale 2-4 (1000 Brussels) implies acceptance without reservation of all the provisions of the present General Conditions (hereafter “the Conditions”) by the consumer (hereafter “the Consumer”).
1.3 visit.brussels reserves the right to change and update the Conditions at any time and without notice.
1.4 The fact that visit.brussels does not invoke a stipulation of the Conditions at a given time cannot be interpreted as a waiver of this stipulation.
Article 2 – Methods of purchase and use of “Tram Experience” tickets
The consumer does not have the right to rescind the purchase.
2.1 Reservation of a Ticket entails immediate payment for it. The only methods of payment accepted are payment online by credit card or bank card on the sites www.visit.brussels / www.tramexperience.brussels or payment onsite in the visitors’ offices located on the Grand-Place or at Rue Royale 2-4.
2.2 The Ticket is valid only on the date and at the time indicated for the amount of persons indicated on the voucher. Only Tickets ordered via the sites www.visit.brussels / www.tramexperience.brussels or in the visitors’ offices are valid. Any falsification of a Ticket will be prosecuted.
2.3 Unless otherwise stipulated by the Organizers, departure and arrival for a “Tram Experience” evening take place at Place Poelaert. The length of the trip is +/- 2 hours. The itinerary, given as a guide, is left to the discretion of the Organizers. The trip does not include a halt.
2.4 The Ticket cannot be used for promotional and/or commercial purposes without the authorisation of visit.brussels.
2.5 Inasmuch as an online contract for provision of catering and leisure services is involved, and in compliance with the Royal Decree of 18 November 2002, the Consumer does not have the right to retraction as provided in Article 47 of the law of 6 April 2010 on market practices and consumer protection.
2.6 The Ticket cannot be reimbursed in any event, even loss or theft, or returned or exchanged, except in the event of cancelation by the Organizers. In the event of cancelation of the dinner trip on the date and at the time indicated on the Ticket, visit.brussels offers the Consumer a choice between postponing the date and time to another date and time or reimbursement for the Ticket.
2.7 Proper dress is required. The Consumer is required to comply with the instructions of the Organizers when boarding and disembarking and during the trip.
2.8 Smoking and/or vaping is prohibited in the Tram. In addition, any food or beverages other than that served in the Tram is prohibited.
2.9 Huisdieren zijn streng verboden in de Tram.
2.9 Pets are strictly forbidden on the Tram Experience.
Article 3 - Personal data
3.1 The data sent by the Consumer upon reservation of a Ticket will be handled in compliance with the provisions of the law of 8 December 1992 on protection of personal data.
These data are used for the following purposes:
- administrative management of the reservations for a “Tram Experience” evening;
- improvement of the service;
- management of billing and payment methods;
- informing the Consumer in the event of cancelation or change in the date and time or departure and arrival location of the “Tram Experience” dinner trip;
- promotional purposes, for communication of information on new services or products of visit.brussels, on condition that the Consumer has ticked the box provided to this effect to indicate his consent;
- communication and transfer to any partner company or company connected with VISITBRUSSELS for survey purposes or direct marketing activities.
3.2 The Consumer who is a natural person can at any time request that he no longer receive mail from visit.brussels and object to any use of his data for marketing purposes by addressing his request by e-mail to firstname.lastname@example.org or by post to the following address: 2-4, Rue Royale, 1000 Brussels.
3.3 In compliance with the law of 8 December 1992 on protection of private life with regard to handling of personal data, the Consumer who is a natural person has a right of access to and rectification of his personal data with visit.brussels. To this effect, the Consumer who is a natural person can address his request by e-mail to email@example.com or by post to the following address: 2-4, Rue Royale, 1000 Brussels.
Article 4 - Liability
4.1 visit.brussels expressly declines all liability with regard to any technical failures of the Tram that might make it temporarily impossible to organise a “Tram Experience” evening. visit.brussels cannot, all the more so, be held liable in the event of delay, failure or interruption of the service due to cases of force majeure or events external to visit.brussels.
4.2 visit.brussels cannot in any event be held liable for the behaviour of the Consumers during a dinner trip.
4.3 visit.brussels does not guarantee the punctuality of the Tram schedule.
4.4 visit.brussels cannot be held liable for any loss or damage (direct, indirect, material or immaterial) experienced during a dinner trip. The same applies to any theft or loss that could occur before or during the dinner trip for which a Ticket is issued.
Article 5 – Fares
5.1 The fares for a “Tram Experience” Ticket are as follows:
- For “Tram” menu: 95€ (VAT incl.) per person + 3,50€ ticketing fee per person.
- For “Experience” menu: 115€ (VAT incl.) per person + 4,00 € ticketing fee per person.
- « Shared table » are sold with a discount of € 10 per person.
5.2 The Consumer undertakes to settle all the amounts due by one of the payment methods made available on the Site or in the visitors’ offices.
5.3 A receipt for VAT is automatically sent electronically the day after the “Tram Experience” evening.
Article 6 - Miscellaneous
6.1 The Consumer acknowledges and accepts that the FAQ are an integral part of the Conditions and that they are incorporated there for reference. visit.brussels can change the FAQ at any time.
6.2 The Conditions are intended to apply exclusively to reservation and use of “Tram Experience” Tickets, to the exclusion of other products of visit.brussels subject to the general conditions for use applicable to them.
Article 7 - Nullity of a clause, applicable law and jurisdiction
7.1 The nullity, lapsed or unenforceable nature of all or part of one of the preceding provisions will not lead to nullity of the other clauses of the Conditions, which will remain applicable. The entirely or partially null, lapsed or unenforceable provision will be deemed not to have been written. visit.brussels undertakes to substitute for this provision another that will insofar as possible perform the same function.
7.2 The Conditions are exclusively governed, interpreted and applied in compliance with Belgian law. The courts and tribunals of Brussels have sole jurisdiction.
