General Sales Terms of the "Tram Experience" Gift Voucher
1.1 The “Tram Experience” is an initiative implemented by the non-profit association VISITBRUSSELS (hereafter referred to as "visit.brussels"), having its registered office at 1000 Brussels, Rue Royale 2-4 Koningsstraat, in partnership with the Société des Transports Intercommunaux de Bruxelles (STIB)/ Maatschappij voor het Intercommunaal Vervoer te Brussel (MIVB).
1.2 The purchase of a Gift Voucher for a “Tram Experience” ride (hereafter referred to as “the Ticket”) via the www.visit.brussels / www.tramexperience.brussels websites or at the points of sales located Grand-Place or Rue Royale 2-4 Koningsstraat (1000 Brussels) implies unconditional acceptance by the consumer (hereafter referred to as “the Consumer”), of all provisions of these General Sales Terms (hereafter referred to as “the Terms”).
1.3 visit.brussels reserves the right to change and update the Terms at any time without prior notice.
1.4 The fact that visit.brussels does not at any time apply a given provision of the Terms shall not be construed as a waiver of this provision.
Article 2 – Terms of purchase and use of a “Tram Experience” Gift Voucher
The Consumer does not have the right to cancel the purchase.
2.1 Booking a Gift Voucher requires immediate payment thereof. The only acceptable forms of payment are on-line payment on the www.visit.brussels / www.tramexperience.brussels websites by credit card or bank card or payment on site in the tourist information offices situated Grand-Place or Rue Royale 2-4 Koningsstraat.
2.2 The Gift Voucher is valid until December the 31st included for the number of guests indicated on the voucher and within the limit of the number of places available. Only the Gift Vouchers purchased via the www.visit.brussels / www.tramexperience.brussels websites or in the tourist information offices are valid. Forgery of a Gift Voucher will lead to legal proceedings.
2.3 Failure to use a Gift Voucher within its period of validity does not imply under any circumstances a right to its refund or exchange. The recipient of a Gift Voucher will make sure to book well in advance in order to have the places available to him/her in good time.
2.4 The Gift Voucher cannot be used for advertising and/or commercial purposes without prior authorization of visit.brussels.
2.5 Since it is a distance contract for the provision of catering and leisure services and in accordance with the Royal Decree of 18 November 2002, the Consumer does not have the right of withdrawal as stated in Article 47 of the Law of 6 April 2010 on market practices and consumer protection.
2.6 Under no circumstances shall the Gift Voucher be refunded, even in case of loss or theft, neither returned nor exchanged. In case of loss of one or several Gift Voucher(s) during or after sending, the Consumer or the recipient shall immediately contact in order to cancel this or these Gift Voucher(s). A new Gift Voucher (which will be valid only up to the same date as the original) will then be issued and sent by visit.brussels.
Article 3 – Personal data
3.1 The data provided by the Consumer when booking a Gift Voucher will be treated in accordance with the law of 8 December 1992 on the protection of personal data.
These data are processed for the following purposes:
- for the administrative management of bookings of “Tram Experience” rides;
- for the improvement of the service;
- for the management of invoicing and arrangements for payment;
- for informing the Consumer in the event of cancellation or change of date and time or places of departure and arrival of the “Tram Experience” dinner ride;
- for advertising purposes, for communicating information on new services or products of visit.brussels provided the Consumer has checked the appropriate box in order to mark his consent;
- communication and transfer for purposes of investigation or direct marketing actions to any partner company or company related to visit.brussels.
3.2 The Consumer natural person can at any time opt-out of receiving e-mails from visit.brussels and oppose the use of his/her personal details for marketing purposes by sending a request by e-mail at email@example.com or by postal mail to the following address: visit.brussels, Koningsstraat 2-4 rue Royale, 1000 Brussels.
3.3 In accordance with the law of 8 December 1992 on the protection of private life with respect to the processing of personal data, the Consumer natural person has with visit.brussels a right to access and correct the personal data concerning him/her. To this end, the Consumer natural person can send a request by e-mail at firstname.lastname@example.org or by postal mail to the following address: visit.brussels, Koningsstraat 2-4 rue Royale, 1000 Brussels.
Article 4 - Liability
4.1 visit.brussels expressly disclaims any responsibility for any possible technical failures of the Tram that would result in the temporary inability to organize a “Tram Experience” ride. All the more, visit.brussels cannot be held liable for any delay, failure or interruption of service due to force majeure, to events outside visit.brussels.
4.2 visit.brussels can under no circumstances be held responsible for the behavior of Consumers during the dinner ride.
4.3 visit.brussels does not guarantee the accuracy of the Tram schedules.
4.4 visit.brussels cannot be held responsible for any loss or (direct, indirect, tangible or intangible) damage incurred during a dinner ride. The same applies for any loss or theft that may occur before or during the dinner ride for which a Ticket is issued.
4.5 visit.brussels does not guarantee continual availability, without error or interruption, of all functions of the www.visit.brussels / www.tramexperience.brussels websites allowing Tickets to be booked.
4.6 visit.brussels is not responsible for the use of the Internet or any other means of communication in the correspondence between the parties.
4.7 visit.brussels is not responsible for delays or loss of Gift Vouchers when sending them.
4.8 visit.brussels is not responsible for misuse of Gift Vouchers by third parties.
Article 5 – Rates
5.1 The rates applying to “Tram Experience” Gift Vouchers are:
- For “Tram” menu : 95€ (VAT incl.) per person + 3,50€ ticketing fee per person.
- For “Experience” menu : 115€ (VAT incl.) per person + 4,00 € ticketing fee per person.
- « Shared table » are sold with a discount of € 10 per person.
5.2 The Consumer agrees to pay all amounts due using one of the means of payment made available on the websites or in the tourist information offices.
5.3 The Consumer is expressly informed that when he/she uses a Gift Certificate valid for a table of 4 persons or a table of 6 persons to reserve a table for 2 persons or for 4 persons, he/she may not subsequently make a reservation for 2 or 4 other persons; the Gift Certificate may only be used once.
The Consumer also is expressly informed that he/she may use a menu «Experience» Gift Voucher (2, 4, or 6 persons, available on Fridays and Saturday only) to reserve a table of 2,4 or 6 persons for the «Tram» menu (available on Tuesday, Wednesday, Thursday en Sunday). The price difference will, however, be lost and non-reimbursed.
Article 6 - Miscellaneous
6.1 The Consumer acknowledges and agrees that the FAQs form an integral part of these Terms and that they are hereby incorporated by reference. The FAQs can be modified at any time by visit.brussels.
6.2 The Terms are intended to apply exclusively to the booking and use of “Tram Experience” Tickets, excluding other visit.brussels products subject to terms and conditions relating thereto.
Article 7 - Nullity of a clause, applicable law and
7.1 The invalidity, lapse or unenforceability of all or part of the above provisions shall not affect the validity or enforceability of the remaining provisions of these Terms, which shall remain applicable. The provision that is totally or partially invalid, void or unenforceable shall be deemed unwritten. visit.brussels undertakes to substitute the provision in question by a provision that most closely complies with the initial intent.
7.2 The Conditions are exclusively governed by, construed and enforced in accordance with Belgian law. The courts and tribunals of Brussels have sole juridiction.
